What is 2257 MAVIS? (Model Age Verification Information System) 2257 MAVIS is a stand-alone Windows
database application that allows adult webmasters to obtain and maintain
compliance with 18 USC 2257 and 28 CFR Part 75 regulations that went into effect
as of June 23, 2005. The 2257 record-keeping software solution you choose as an adult industry webmaster will be one of the most crucial business decisions you will make to ensure compliance with 18 USC 2257 and 28 CFR Part 75. Your decision could mean the difference between freedom or significant financial loss along with the potential for several years in federal prison. Now that inspections have started, arrests are being made and plea bargains are costing millions of dollars to offenders of 18 USC 2257 and 28 CFR Part 75 regulations, if you don't have your copy of 2257 MAVIS installed and working to keep your butt out of jail, you could be in for a big surprise when the DOJ inspectors knock on your door. If you have been waiting to "see what happens" the best advice to you is not to wait any longer. The DOJ is actively inspecting companies to make sure they are 2257 compliant and the new Adam Walsh Child Protection and Safety Act of 2006 recently signed into law is putting real teeth into the bite of 18 USC 2257. On December 28, 2005 Judge Walker D. Miller issued a preliminary injunction against the enforcement of the 18 USC 2257 and 28 CFR Part 75 regulations that went into effect on June 23, 2005, however the ruling is not without stipulations. Judge Miller decided to align his decision with that of the Sundance decision (also from the US 10th District court) in that parts of the new regulations requiring secondary producers, or those who do not have contract or hiring and/or managerial relationships with models producing adult content, who are also members of the FSC as of June 29, 2005, to keep 2257 records was unconstitutional. He also stipulated that primary producers, i.e., those who actually produce content, do not have to maintain a list of all URLs containing their content located on websites outside of their control. As primary producers they do have the responsibility of maintaining list of URLs on websites over which they have direct control. While this ruling by Judge Miller is touted by the Free Speech Coalition to be a significant victory, you can be assured there will be appeals by the Department of Justice and further revision of 18 USC 2257 by the U.S. Congress to ensure the laws requiring the appropriate keeping of records are enforceable. You need to be aware that while Judge Miller's ruling appears to apply to the industry as a whole, this is simply, legally, not the case. His ruling technically only applies to the US 10th District Court which covers Oklahoma, Kansas, New Mexico, Colorado, Wyoming, and Utah and parts of Montana and Idaho containing Yellowstone National Park. This means that MOST of the adult industry is actually, technically, not protected by this ruling as their business locations are actually outside of the US 10th District. If you need more information regarding these regulations you can read the latest published version of them here: 18 USC 2257 and 28 CFR Part 75 Adult webmasters are urged to consult their attorney to obtain counsel and advice as to their responsibilities to obtain and maintain compliance with 18 USC 2257 and 28 CFR Part 75. Most competent attorneys will tell you to get your 2257 records in order immediately. The fastest and best way to obtain and maintain this compliance is to use 2257 MAVIS to manage your 2257 records!
