What is 2257 MAVIS? (Model Age Verification Information System)

2257 MAVIS is a stand-alone Windows database application that allows adult webmasters to obtain and maintain compliance with 18 USC 2257 and 28 CFR Part 75 regulations that went into effect as of June 23, 2005.

The 2257 record-keeping software solution you choose as an adult industry webmaster will be one of the most crucial business decisions you will make to ensure compliance with 18 USC 2257 and 28 CFR Part 75.  Your decision could mean the difference between freedom or significant financial loss along with the potential for several years in federal prison.

Now that inspections have started, arrests are being made and plea bargains are costing millions of dollars to offenders of 18 USC 2257 and 28 CFR Part 75 regulations, if you don't have your copy of 2257 MAVIS installed and working to keep your butt out of jail, you could be in for a big surprise when the DOJ inspectors knock on your door. If you have been waiting to "see what happens" the best advice to you is not to wait any longer.

The DOJ is actively inspecting companies to make sure they are 2257 compliant and the new Adam Walsh Child Protection and Safety Act of 2006 recently signed into law is putting real teeth into the bite of 18 USC 2257.

On December 28, 2005 Judge Walker D. Miller issued a preliminary injunction against the enforcement of the 18 USC 2257 and 28 CFR Part 75 regulations that went into effect on June 23, 2005, however the ruling is not without stipulations.

Judge Miller decided to align his decision with that of the Sundance decision (also from the US 10th District court) in that parts of the new regulations requiring secondary producers, or those who do not have contract or hiring and/or managerial relationships with models producing adult content, who are also members of the FSC as of June 29, 2005, to keep 2257 records was unconstitutional.

He also stipulated that primary producers, i.e., those who actually produce content, do not have to maintain a list of all URLs containing their content located on websites outside of their control.  As primary producers they do have the responsibility of maintaining list of URLs on websites over which they have direct control.

While this ruling by Judge Miller is touted by the Free Speech Coalition to be a significant victory, you can be assured there will be appeals by the Department of Justice and further revision of 18 USC 2257 by the U.S. Congress to ensure the laws requiring the appropriate keeping of records are enforceable.

You need to be aware that while Judge Miller's ruling appears to apply to the industry as a whole, this is simply, legally, not the case.  His ruling technically only applies to the US 10th District Court which covers Oklahoma, Kansas, New Mexico, Colorado, Wyoming, and Utah and parts of Montana and Idaho containing Yellowstone National Park.  This means that MOST of the adult industry is actually, technically, not protected by this ruling as their business locations are actually outside of the US 10th District.

If you need more information regarding these regulations you can read the latest published version of them here: 18 USC 2257 and 28 CFR Part 75

Adult webmasters are urged to consult their attorney to obtain counsel and advice as to their responsibilities to obtain and maintain compliance with 18 USC 2257 and 28 CFR Part 75.  Most competent attorneys will tell you to get your 2257 records in order immediately.

The fastest and best way to obtain and maintain this compliance is to use 2257 MAVIS to manage your 2257 records!  There is no other more fully compliant 2257 software available at any price.

2257 MAVIS was recently reviewed by a well known adult industry attorney and here is what he had to say about the software and its ability to comply with the current 2257 regulations.

Features

  • Stand-alone Windows database application - The new 2257 regulations are very strict about the type of application used to access the data in the database. The use of a stand-alone application is mandated by 28 CFR, Part 75 according to attorneys we have contacted. Web or network server based solutions are not appropriate for the purposes of 2257 compliance due to the possibility of seizure by Department of Justice investigators for infractions of 2257 regulations or other potentially criminally punishable violations that might result during an inspection based upon 'plain sight' rules of evidence.

  • Proprietary database format - ensures security. Only 2257 MAVIS can access the data contained in the database.  No SQL database administrator or complex database servers required.  You can store hundreds of thousands of model photo ids in the database without worrying about file size limitations.*

  • Multi-user / workstation capable - As long as your main designated 2257 computer is connected to a network using a shared data resource location multiple users can enter information into the database. The only restriction to this ability is the use of the web spider import option, which requires exclusive access to the database files in order to perform batch processing.

  • Exact compliance with 18 USC 2257 and 28 CFR, Part 75 - Only the information specifically designated by the new regulations is stored in the database. Photo IDs and images of affidavits are the only valid images that may be stored in the database.  Thumbnails of productions or Model Releases are not stored in the MAVIS database because that would be a violation of 28 CFR, Part 75.

  • Website Spider Option - With the MAVIS Spider Edition you can easily collect information for all of your productions on your web sites (for multiple domains if desired) and dramatically reduce your level of effort in becoming compliant with the new 2257 regulations. You will easily eliminate 90 percent of the data entry task by using the MAVIS Spider Import process.

  • Built-in scanning interface - You can import digital images of model's photo ids or identity affidavit copies or you can scan them directly into 2257 MAVIS. It's your choice.

  • Built-in image manipulation capabilities - allow you to rotate, flip or crop images from directly within 2257 MAVIS.  No need to "pre-process" images with Photoshop or some other third party imaging software.

  • Separate Inspection Query application - Department of Justice inspectors will not have access to data entry or modification routines. They perform their inspections via a stand-alone querying application that makes it impossible for your 2257 data to be modified accidentally through DOJ access.

  • Detailed model reports - provide DOJ inspectors with a comprehensive model identification report detailing all of the model's age information, aliases and productions, including age at date of production creation.  Model's photo id is reproduced as a grayscale image to reduce the probability of fraudulent use. Reports may be printed as hard copy or automatically converted to PDF files for electronic transfer by DOJ inspectors. See the screen capture of the example report.

  • Software Escrow Services - Your 2257 record keeping solution is one of the most important software investments you will own for the next several years. Software escrow services are available to protect your investment against developer death or disability. We've all heard the jokes about the programmer who gets hit by the bus, but what about the much more likely scenario of the developer who dies or becomes disabled due to a heart attack or stroke?  We guarantee you access to the MAVIS source code and a qualified replacement developer in the event of developer death or disability, or the dissolution of Brady & Associates, LLC, the developers of 2257 MAVIS.  Please contact us for more information regarding the availability and use of the software escrow services.

* image sizes should be limited to the size of driver's license or passport photo pages.  Maximum size of images of photo ids to be stored should not exceed 96 dpi 24 bit RGB and 3.5 by 2.25 inches (or in the case of passport photos 5 x 3.5 inches)  with a file size between 40 ~ 100 Kb. It is recommended that you scan photo ids into the system in order to obtain the most legible images possible. It is a requirement of 2257 regulations that the image and the text  information contained on the photo id document be legible.  For identification affidavits, it is recommended that you scan them at a resolution no higher than 200 dpi, grayscale with a file size of 100 ~ 200 Kb  28 CFR Part 75 requires either a photo id OR an affidavit but NOT both!
